Legal Requirements For Getting Married In St. Barts

Saint Barthelemy (St. Barths) is an Overseas Collectivity under French law.  A complete dossier must be submitted at least one month in advance of the wedding date.  The dossier must include the following:

A letter dated and signed by the future spouses addressed to the civil registry requesting an application.

Complete copies of birth certificates for each of the parties and issued and dated no more than six months before the wedding. Certificates issued by foreign authorities must be translated and legalized according to the registrations applicable in their native country.

Proof of identity for each of the future spouses via a valid passport or a visa (or the request for a visa) when such is required to stay in the Collectivity.

Last names, first names, dates and places of birth for the father and mother of the future spouses, their addresses and professions.

Last names, first names, dates and places of birth for the witnesses, their addresses and professions.

A certificate of law relative to the regulation in the native country concerning marital status (legality, publication of banns, etc.) issued by the Consulate or Embassy of the country concerned.

Certificate of matrimonial capacity or certificate of celibacy issued by the Consulate or Embassy of the country concerned

Proof of personal residence or, if one or both of the parties do not actually live on the island, they must furnish a document proving their continuous presence in the Collectivity for one month before the date they deliver their dossier

The civil registry office requires that an officially accepted translator/interpreter as selected by the future spouses is there to ensure the translation of the marriage ceremony.

Marriages celebrated by couples of foreign nationality must respect the following requirements:

Prohibition of polygamy

Prohibitions for marriage between direct relatives, between brother and sister, between uncle and niece, or aunt and nephew.

The presence of each of the future spouses during the celebration of the marriage

Freedom of consent

The legal age to be married is 18 years or older

Cerebration of the marriage before a public official competent to perform the ceremony

The complete dossier must be delivered to the civil registry office personally.
